LIMIT OF LIABILITY: In the unlikely event that the assigned photographer is unable to perform to the guidelines of this contract due to an injury, illness, or other cause beyond the control of John Kalad Photography, the Company, will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event(s).
In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the Company's control, including but not limited to camera, hard drive, or equipment malfunction, the Company liability is limited to the return of all payments received for the event(s).
CAPTURE AND DELIVERY: The Company is not liable to deliver every image taken at the event. The determination of images delivered to the client is left to the discretion of the Company.
POST PRODUCTION AND EDITING: The final post production and editing styles, effects and overall look of the images are left to the discretion of the Company.
CANCELLATIONS: If the wedding event is cancelled and the engagement session, if included in your package, has already been provided, you will be entitled to pay the engagement session fee of $300. Failure to cancel within 2 weeks of the event(s) will result in the higher of 50% of wedding package total or monies already paid. Wedding Retainers are non-refundable.
DAY OF EVENT: For wedding packages of 8 hours or more, meals must be provided for photographer & any other photographers, videographers or company personnel if applicable, during the normal dinner hour. If meals are not provided, company staff will be entitled up to a 1-hour break from your wedding coverage total hours to obtain a meal and break.
In consideration for value received, please note that by signing this agreement, I hereby give John Kalad Photography the absolute right and permission to publish, copyright and use pictures agreed in this agreement in which I may be included in whole or in part, composite or retouched for John Kalad Photography at no compensation. Photos will not be released until balance is paid in full. Cancellations must be communicated at least 2 weeks in advance from the wedding date.
